All Kelly Sports clinics and Kelly Sports Holiday Programmes may be referred to as 'Kelly Sports Programmes' in the following Terms and Conditions.
1. PAYMENT REGISTRATION:
1.1 Kelly Sports Clinics:
Enrolling in a Kelly Sports Clinic secures a booking for the entire duration of the programme. Payment is required per programme, irrespective of attendance, and is due on the invoice date. Parents/caregivers and children are responsible for programme attendance.
1.2 Kelly Sports Programmes:
Enrolling in a Kelly Sports Programme secures a booking for the selected days/times. Payment is still required for the full booking, even if a child is absent, unless prior notice of the absence is provided (minimum 24 hours or as specified in programme-specific booking information). Parents/caregivers and children are responsible for programme attendance.
1.3 Programme Length:
The duration of Kelly Sports Programmes may vary based on location and programme type.
1.4 Late Payment:
Late payment will be considered a default under this agreement, and Kelly Sports reserves the right to withdraw children from programmes at its discretion. Additional administration fees may apply to overdue accounts.
1.5 Early Drop-offs or Late Pick-ups:
Extra charges will apply if children arrive before or are collected after the scheduled programme times. Late pick-ups will incur a fee of $20 per 15 minutes or part thereof.
1.6 Indemnity:
The parent/caregiver agrees to indemnify Kelly Sports Programmes against all costs, whether commissions, legal fees or otherwise, incurred by Kelly Sports Programmes or their duly Authorised Agents relating to the recovery of any monies that may be outstanding from time to time pursuant to the terms of this agreement..
1.7 Discontinued Sessions:
Kelly Sports Programmes reserves the right to discontinue any child from the programme for reasons including, but not limited to, inappropriate behaviour or non-payment of fees.
1.8 Programme Costs:
Programme costs are reviewed annually, or as needed, and parents/caregivers will be notified of any changes with at least one month's notice, where possible.
1.9 Programme Policies and Procedures:
By enrolling your child in a Kelly Sports programme, you agree to the terms and conditions in the Kelly Sports Programme Policies and Procedures Manual. This manual is approved by the Ministry of Social Development and is available at all OSCAR programme venues.
1.10 Work and Income OSCAR Subsidies:
Applying for an OSCAR subsidy is the responsibility of parents/caregivers. Kelly Sports is not responsible for ensuring that documents are completed or sent to Work and Income. Parents/caregivers will be responsible for paying full fees if the subsidy application is unsuccessful.
2. REFUNDS:
2.1 Kelly Sports Missed Sessions:
No refund will be provided for missed sessions or for early withdrawal from sessions during the term.
2.2 Kelly Sports Cancelled Sessions:
If a session is cancelled and no catch-up session is available, the fee will be credited to the next term.
2.3 Kelly Sports Holiday Programme Missed Sessions:
No refund will be provided for missed sessions unless Kelly Sports is notified at least 24 hours before the session commences. (or as specified in programme-specific booking information).
3. WEBSITE
3.1 Website Access:
Children, parents, and caregivers will have access to the online content of the website (www.kellysports.co.nz) for the duration of their enrolment in Kelly Sports programmes.
4. CHILD HEALTH AND SAFETY
4.1 Medical Information:
Medical information: In the interests of your child’s well-being, whilst in the care of Kelly Sports programmes, the programme must be informed of any medical or other condition affecting your child. This information should be included in your ‘Child’s Details’ in your online account, and updated if conditions develop or change.
4.2 Liability for Children Outside Programme Times:
Kelly Sports is not responsible for children outside of the agreed programme hours or for children travelling to and from the venue. Kelly Sports' policies on ‘Drop Off/Pickup of Children’, ‘Children Not Arriving at Programme When Expected’, and ‘Children Not Collected at the End of the Programme’ will apply.
4.3 Health and Safety Emergencies:
In an emergency situation where your child needs medical attention, staff will ensure that every effort possible is made to get hold of the parents/caregivers/emergency contacts. If contact is unsuccessful, I authorise any person (acting through the staff and employees of Kelly Sports Programmes) in the event of any accident or illness to my child, to take all such steps as may be necessary for the proper treatment and care of my child (as advised by a duly qualified and registered medical practitioner).
4.4 Collection of Unwell Children:
Parents/caregivers are expected to be able to collect their child at any time if they become unwell, jeopardise the safety of other children or coaches at the programme, or are identified as a health risk to other children or coaches at our programme.
4.5 Abuse Prevention:
Kelly Sports OSCAR programmes are committed to the recognition and prevention of abuse of children within our programmes and the community and supports the roles of statutory agencies such as the Police and the Ministry for Children (Oranga Tamariki).
5. PRIVACY AND COPYRIGHT
5.1 Advertising:
Kelly Sports may photograph or record videos of sessions for promotional or training purposes. By enrolling your child, you agree to the use of their images unless you provide written notice to opt-out during enrolment. If broader use of images is planned, you will be contacted to obtain consent.
5.2 Personal Information:
Kelly Sports Programmes collect, use and share your information in accordance with the Kelly Sports NZ Privacy Policy. The most current version of our Privacy Policy can be found below.
5.3 Copyright:
Parents/caregivers agree not to copy or use any Kelly Sports Programme material or intellectual property unless explicitly authorised by Kelly Sports NZ in writing.
6. GENERAL
6.1 Consent to Participate in Activities:
I consent to my child participating in/attending activities arranged by Kelly Sports Programmes, as well as travel by private vehicle or public transport/alternative transport services as may be used from time to time to advertised programme outings.
6.2 Travelling by Private Car:
If there is a need for children to travel by private car, parents/caregivers will provide booster seats or the appropriate required child restraint for the age and size of their child. Parents/caregivers of children seven years or older are encouraged to provide booster seats for their children until they reach 148cm tall, or eleven years old. A separate written authorisation will be required from parents/caregivers before travelling.
6.3 Belongings:
Kelly Sports is not responsible for any loss or damage to children’s belongings during programmes.
7. ONLINE STORE
7.1 Delivery Information:
All deliveries within New Zealand are typically processed within 5 business days. International shipping is not available.
7.2 PCI Statement:
Kelly Sports uses SSL encryption and does not store credit card details. Payments are processed securely by a third-party PCI-compliant service.
7.3 Currency:
All transactions are processed in New Zealand Dollars.
